Please read these Terms carefully. By accessing or using On The Way Rides, you agree to these Terms of Service.

These Terms are provided for platform use and operational clarity. They should be reviewed by qualified legal counsel before final publication.

1. Introduction

Welcome to On The Way Rides. These Terms of Service govern your access to and use of the On The Way Rides mobile application, website, marketplace, driver portal, admin-supported services, communications, and related features operated by On The Way Rides LLC.

By using our services, creating an account, requesting a ride, applying to drive, placing marketplace orders, communicating with support, or using any related feature, you agree to be bound by these Terms.

2. Description of Service

On The Way Rides is a technology platform that may connect riders with independent drivers, allow customers to access marketplace services, allow merchants to receive and manage orders, and allow drivers to receive ride or delivery opportunities where available.

On The Way Rides does not provide transportation services directly and is not a transportation carrier. Drivers are independent contractors and are not employees, agents, or representatives of On The Way Rides LLC.

3. Eligibility

  • You must be at least 18 years old to create a standard rider account unless a supported teen account feature is available and properly authorized.
  • You must provide accurate, current, and complete information.
  • You must have the legal authority to enter into these Terms.
  • You may not use the platform if your account has been suspended, terminated, or restricted by On The Way Rides.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for activity that occurs under your account.
  • You agree to keep your phone number, email, payment information, and account details accurate.
  • You must notify us promptly if you believe your account has been accessed without authorization.

5. Rider Accounts and Ride Requests

Riders may request ASAP rides or scheduled rides through the app when service is available. Ride availability may depend on operating hours, driver availability, location, weather, demand, service area, and other operational factors.

  • ASAP ride availability may be open or closed based on business settings.
  • Scheduled rides must fall within available business operating hours.
  • Business hours may include multiple open windows per day and gaps where service is closed.
  • Estimated wait times, arrival times, fares, and availability are not guaranteed.

6. Scheduled Rides and Operating Hours

Scheduled ride options are subject to the hours of operation configured by On The Way Rides. If service is closed during a gap in operating hours, riders may not be able to schedule rides during that closed period.

On The Way Rides may modify operating hours, availability, service areas, scheduling rules, or booking restrictions at any time.

7. Driver Accounts and Driver Applications

Users may apply to drive through the app, including through a "Drive With Us" option where available. Applying to drive does not guarantee approval.

Driver applicants may be required to submit personal information, profile photos, driver license information, vehicle information, insurance information, registration documents, background or compliance information, selfie verification, Stripe payout setup, and other information required by On The Way Rides.

  • Drivers must maintain accurate and current application information.
  • Required documents may be approved, rejected, expired, pending review, or require reupload.
  • Drivers may not go online unless all required eligibility, verification, document, selfie, payout, and compliance requirements are satisfied.
  • On The Way Rides may approve, reject, suspend, reset, or require re-verification of driver profiles at its discretion.

8. Driver Verification, Documents, and Selfies

Driver verification may include document review, profile photo approval, selfie verification, AI-assisted review, admin review, and periodic re-verification.

  • Selfie verification may be compared against an approved driver profile photo.
  • If automated verification confidence is below required thresholds, the driver may be asked to retake the selfie or may be sent to admin review.
  • Admins may request selfie verification at any time when needed for safety, compliance, or identity verification.
  • Pending selfie verification requests may block a driver from going online.
  • Documents dated today or in the past may be treated as expired or requiring admin review.

9. Motion Safety During Verification

For safety, drivers may be blocked from taking verification selfies or uploading driver verification documents if the app detects that the driver is moving faster than the allowed safety threshold.

If motion is detected, the driver may be required to pull over in a safe place and come to a complete stop before continuing.

10. Payments, Fares, Fees, and Charges

Riders agree to pay all applicable charges shown or calculated through the app, including ride fares, service fees, wait-time fees, cancellation fees, marketplace order charges, delivery fees, taxes, tips, and other applicable charges.

Final charges may differ from estimates due to route changes, wait time, tolls, promotions, cancellations, adjustments, or other operational factors.

11. Wait-Time Fees

If a driver arrives and marks themselves as waiting, wait-time rules may apply. Riders may receive in-app, push, or SMS notices when a driver is waiting and before wait-time charges begin.

Wait-time fees, thresholds, and warnings may vary based on current app settings and business rules.

12. Cancellations and Refunds

Cancellation fees may apply if a ride or order is canceled after acceptance, after dispatch, after preparation has begun, or according to applicable platform rules.

Refunds, credits, or adjustments are issued at the discretion of On The Way Rides unless otherwise required by law. Refund processing times may vary by payment provider.

13. Promotions and Discounts

Promotions may be limited to rides, marketplace orders, or both, depending on how the promotion is configured by On The Way Rides.

  • Ride-only promotions may not apply to marketplace orders.
  • Marketplace-only promotions may not apply to rides.
  • Universal promotions may apply to both if configured that way.
  • Promotions may be subject to expiration dates, usage limits, minimum purchase amounts, eligibility requirements, and other restrictions.

On The Way Rides may modify, pause, or cancel promotions at any time.

14. Marketplace Services

Where marketplace features are available, customers may browse merchants, place orders, use eligible promotions, track order status, and receive delivery updates.

Merchants are responsible for their products, menu information, order preparation, availability, pricing where applicable, and compliance with applicable laws. On The Way Rides may facilitate order management, delivery coordination, payments, and support.

15. Merchant Accounts

Merchants using the platform must provide accurate business information, maintain current menu and availability information, manage incoming orders in a timely manner, and comply with applicable laws and platform requirements.

Merchant access may be suspended or terminated for misuse, repeated order issues, fraud, safety concerns, or violation of these Terms.

16. Driver Payouts and Stripe Connect

Driver payouts may be processed through Stripe Connect or another third-party payment provider. Drivers may be required to complete Stripe onboarding before receiving payouts.

  • Drivers are responsible for providing accurate payout, tax, and identity information.
  • Stripe may require additional information before payouts are enabled.
  • On The Way Rides is not responsible for delays caused by incomplete Stripe requirements, bank processing times, or third-party payment provider issues.
  • Admins may reset a driver's connected Stripe account when necessary, without deleting historical earnings or payment records.

17. SMS, Push Notifications, and Communications

By providing your phone number and opting in where required, you agree to receive transactional messages from On The Way Rides related to account activity, verification codes, ride updates, driver notifications, marketplace order updates, document review, support, and safety notices.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of SMS or HELP for help. Opting out of SMS may affect your ability to receive certain service-related notices.

On The Way Rides does not send marketing SMS under transactional service messaging unless separately authorized.

18. User Conduct

  • You may not use the platform for unlawful, unsafe, abusive, fraudulent, or harmful purposes.
  • You may not harass, threaten, abuse, discriminate against, or endanger riders, drivers, merchants, support staff, or other users.
  • You may not provide false, misleading, expired, or fraudulent information.
  • You may not interfere with platform operations, dispatch, payments, verification, or security systems.

Violations may result in suspension, termination, removal from the platform, or referral to appropriate authorities where necessary.

19. Driver Conduct

  • Drivers must operate safely, legally, and professionally.
  • Drivers must maintain valid license, registration, insurance, and required approvals.
  • Drivers must not operate while impaired, distracted, unsafe, or legally prohibited from driving.
  • Drivers must not allow another person to use their driver account.
  • Drivers must comply with platform safety, verification, document, and conduct requirements.

20. Safety

Safety is important to On The Way Rides, but use of the platform involves risks. Riders, drivers, merchants, and users are responsible for exercising good judgment and following applicable laws.

In an emergency, call 911 or local emergency services immediately. The app and support channels are not a substitute for emergency services.

21. AI-Assisted Features

On The Way Rides may use AI-assisted features for recommendations, verification support, fraud prevention, document review support, selfie confidence checks, operational insights, or customer support suggestions.

AI-assisted results may be reviewed by admins where needed. On The Way Rides may correct, override, or require manual review of AI-assisted decisions.

22. Account Deletion, Driver Profile Wipe, and Reset

Users may request or perform account deletion where supported. If a driver profile is deleted or reset, active driver application data may be wiped so the user must start a fresh driver application if they return.

Completed rides, completed orders, receipts, payment records, payout records, support records, audit logs, and other records required for business, legal, tax, safety, or compliance purposes may be retained as allowed by law and described in our Privacy Policy.

23. Service Availability

On The Way Rides may modify, suspend, limit, or discontinue any feature or service at any time, including ASAP rides, scheduled rides, marketplace features, driver onboarding, promotions, payments, SMS, or support features.

We do not guarantee uninterrupted or error-free service.

24. Intellectual Property

The On The Way Rides name, logos, branding, app content, website content, designs, software, workflows, and platform materials are owned by or licensed to On The Way Rides LLC. Unauthorized use is prohibited.

25. Privacy

Your use of the platform is also governed by our Privacy Policy, available at: https://onthewayrides.com/privacy

26. Third-Party Services

The platform may rely on third-party providers for payments, Stripe Connect, maps, SMS, push notifications, email, hosting, analytics, identity checks, AI features, and other services. Your use of those features may also be subject to third-party terms and policies.

27. Disclaimers

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, On The Way Rides disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

28. Limitation of Liability

To the fullest extent permitted by law, On The Way Rides LLC is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, business opportunities, or other intangible losses.

29. Indemnification

You agree to defend, indemnify, and hold harmless On The Way Rides LLC, its owners, employees, contractors, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, your violation of law, or your conduct.

30. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after updated Terms are posted or provided constitutes acceptance of the updated Terms.

31. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.
